Subject: Policy on Improper Deductions for Exempt Employees
This Policy only applies to Exempt Employees as defined in the Fair Labor Standards Act ("FLSA").
- Improper Deductions
- deductions for less than full-day absences;
- deductions when the employee is ready, willing and able to work, but work is not available; and
- deductions when the employee appears for jury duty, attends court as a witness or is on temporary military leave, however, the University can offset any amounts received by the employee as jury fees, witness fees or military pay.
Exempt employees who believe that they their pay has an improper deduction may file a grievance under the University System of Maryland Policy on Grievances for Exempt and Nonexempt Staff Employees (VII-8.00). If it is determined that the exempt employee's pay has been improperly deducted, the University will reimburse the employee during the next earliest possible pay period.
University of Maryland University College prohibits improper deductions from pay. The following are examples of improper deductions:
