SUBJECT: Policy on Improper Deductions for Exempt Employees
- Application
This Policy only applies to Exempt Employees as defined in the Fair Labor Standards Act ("FLSA"). - Improper Deductions
University of Maryland University College prohibits improper deductions from pay. The following are examples of improper deductions:- deductions for less than full-day absences;
- deductions when the employee is ready, willing and able to work, but work is not available; and
- deductions when the employee appears for jury duty, attends court as a witness or is on temporary military leave, however, the University can offset any amounts received by the employee as jury fees, witness fees or military pay.
- Grievances
Exempt employees who believe that they their pay has an improper deduction may file a grievance under the University System of Maryland Policy on Grievances for Exempt and Nonexempt Staff Employees (VII-8.00). If it is determined that the exempt employee's pay has been improperly deducted, the University will reimburse the employee during the next earliest possible pay period.
