SUBJECT: Administrative Leave Usage

USM policy VII-7.20, Policy on Separation of Regular Exempt Employees, provides that "the institution Chief Executive Officer (CEO) may approve a request for administrative leave or may require an employee to take administrative leave for any purpose considered to be in the best interests of the institution." The following procedures are established to govern this aspect of the USM policy:

Administrative leave pending involuntary separation:

Regular exempt employees – An exempt employee who is notified of termination may be placed on administrative leave for any or all of the period of notice. In this case, the employee shall not earn other paid leave (annual, sick, holiday, personal) during the period of administrative leave.

Regular non-exempt employees – A non-exempt employee who is notified of rejection on probation or termination may be placed on administrative leave for any or all of the period of notice.

Administrative Leave pending layoff:

A regular exempt or non-exempt employee who is notified of a pending layoff may be placed on administrative leave for all or part of the period of notice.

Administrative leave for any other purpose considered to be in the best interests of the institution:

If in the best interests of the institution, the President may approve a request for administrative leave or may require an employee to take administrative leave.

In all of the above instances, the written notice to the employee about the personnel action shall also inform the employee of his or her administrative leave status. The Approval of Administrative Leave Form shall be completed and signed by the President prior to the start of the administrative leave. This form shall be filed in the employee's personnel file.
